Terms and Conditions for Private Swimming Lessons
1. Introduction These terms and conditions govern the relationship between SwimEasy, hereinafter referred to as the "Swimming Instructor," and the customer, hereinafter referred to as the "Client," for private swimming lessons. By engaging the services of the Swimming Instructor, the Client agrees to be bound by these terms and conditions.
2. Lesson Booking and Payment
2.1 Lesson Booking a. Lessons can be booked by contacting the Swimming Instructor via phone, email, or through the online booking system. b. Lesson availability is subject to the Swimming Instructor's schedule and prior bookings. Booking requests will be confirmed based on availability.
2.2 Lesson Fees a. The Client agrees to pay the agreed-upon lesson fee per session, as determined by the Swimming Instructor. Lesson fees are subject to change, but any changes will be communicated to the Client in advance. b. Payment for lessons is due prior to the commencement of each session, unless alternative arrangements have been agreed upon. c. Payment can be made via cash, electronic transfer, or any other payment method accepted by the Swimming Instructor.
2.3 Group lessons should be paid prior to the chosen block of 1,4 or 12 lessons. These should be paid in full for the group. If 2 families decide to share the fee this must be paid to the instructor by 1 total payment for the class. 2 or 3 separate payments can not be accepted.
3. Lesson Cancellation and Rescheduling
3.1 Client Cancellation a. If the Client wishes to cancel a lesson, they must notify the Swimming Instructor at least 24 hours before the scheduled lesson time. No Refunds will be given for lessons cancelled unless they are accompanied by a medical note. Failure to provide adequate notice or MC may result in the Client being charged for the lesson. b. Providing cancelation is because of MC the instructor will attempt to reschedule a "make up" without incurring additional charges, subject to the Swimming Instructor's availability.
3.2 Instructor Cancellation a. In the event that the Swimming Instructor needs to cancel a lesson due to unforeseen circumstances such as illness or emergencies, the Swimming Instructor will provide as much notice as possible and will make reasonable efforts to reschedule the lesson at a mutually convenient time. b. If a lesson cannot be rescheduled, the Swimming Instructor will refund the Client the amount paid for the canceled lesson.
3.3. In a group setting if 1 child is forced to cancel due to illness the calculated lesson fee can be refunded pro rata to one child and a make up lesson will not be provided as the child is deemed part of "a group".
3.4. Lessons will only be cancelled in the event of lightning. Rain is not a reason to cancel. If lightning forces cancellation a make up lesson will be offered in the first instance.
3.5. In the event of a lesson cancelled mid way through (due to weather) there will be no refund or make up class if 50% of the lesson has been completed.
4. Lesson Conduct and Safety a. The Client agrees to follow all instructions provided by the Swimming Instructor during lessons. b. The Client is responsible for providing a suitable and safe swimming environment, including access to a pool that meets appropriate safety standards. c. The Swimming Instructor will take reasonable precautions to ensure the safety of the Client during lessons but cannot be held liable for any accidents, injuries, or damages that may occur during or as a result of the lessons.
4.1. Children should come to every lesson with tight fitting costume or trunks, a swimming cap, goggles and their SwimEasy Passport to Successful Swimming.
5. Confidentiality and Privacy a. The Swimming Instructor will respect the privacy of the Client and will not disclose any personal or confidential information shared during the course of the lessons, unless required by law. b. The Swimming Instructor may request permission to use photographs or videos taken during lessons for promotional purposes. The Client has the right to refuse such requests.
6. Limitation of Liability a. The Swimming Instructor will not be held liable for any loss, damage, or injury arising from the Client's participation in the swimming lessons, except in cases of wilful misconduct or negligence. b. The Client acknowledges that swimming lessons involve inherent risks, and they voluntarily assume all such risks associated with participating in the lessons.
7. Termination Either party may terminate the agreement for private swimming lessons by providing written notice to the other party. The termination will be effective upon receipt of the notice.
8. Governing Law and Jurisdiction These terms and conditions shall be governed by and construed in accordance with the laws of Singpaore. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Singapore.
By engaging the services of the Swimming Instructor, the Client acknowledges that they have read, understood, and agreed to abide by these terms and conditions.
Terms and Conditions for STA International Teacher Training Courses for Swimming Teachers
Please read these terms and conditions carefully before enrolling in our teacher training courses for swimming teachers. By enrolling in our courses, you agree to be bound by the following terms and conditions:
1. Course Enrolment: a. Enrolment in our teacher training courses is subject to availability. b. You must be at least 16 years old to enrol in our courses. c. By enrolling, you confirm that you meet the prerequisites and requirements specified for the course.
2. Payment and Fees: a. The fees for our teacher training courses are clearly stated on our website or provided upon inquiry. b. Payment for the course must be made in full prior to the course start date, unless otherwise agreed upon. c. All fees paid for the courses are non-refundable, except as outlined in the Cancellation and Refund Policy (see section 5).
3. Course Materials: a. Course materials, including manuals, handouts, and online resources, are provided for the duration of the course. b. The course materials are protected by copyright and are for your personal use only. They may not be reproduced or shared without prior written consent from us.
4. Attendance and Completion: a. Regular attendance and active participation are required throughout the course. b. You must complete all required assignments, assessments, and examinations to receive a certificate of completion. c. We reserve the right to withhold the certificate if you fail to meet the course requirements.
5. Cancellation and Refund Policy: a. If you wish to cancel your enrolment, you must notify us in writing as soon as possible. b. Refunds will be provided according to the following schedule:
6. Code of Conduct: a. You are expected to conduct yourself in a professional and respectful manner throughout the course. b. Any form of harassment, discrimination, or disruptive behaviour towards instructors or fellow participants will not be tolerated. c. We reserve the right to remove any participant from the course if their behaviour is deemed inappropriate, without providing a refund.
7. Limitation of Liability: a. We will make every reasonable effort to provide accurate and up-to-date information in our courses and materials. However, we do not guarantee the completeness, accuracy, or reliability of any information provided. b. We shall not be held liable for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use the information or materials provided in the course.
8. Intellectual Property: a. All intellectual property rights, including but not limited to course content, materials, and resources, are owned by SwimEasy and STA. b. You may not reproduce, distribute, or modify any course materials without our prior written consent.
9. Governing Law and Jurisdiction: These terms and conditions shall be governed by and construed in accordance with the laws of Singapore. Any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Singapore.
